Tips To Overcome The Traffic Citation

Friday, November 5th, 2010

If you are charged with breaking the law, such as getting a speeding ticket, in the eyes of the law everyone is supposed to be treated equally. Just because someone has been charged doesn’t mean they are guilty, a court must determine this.

By knowing your legal rights, you can have a better chance to beat a speeding ticket. This will require some effort though.

So to beat a speeding ticket, lets start with the scene of the flagging down, you have the right to limit your answers to a polite “no, officer” and “yes officer.” Known as the Miranda Rights, you are free not to admit your guilt or answer questions that can possibly lead to self-incrimination, especially without the presence of a lawyer.

But obviously you want to be cooperative with the officer. You DO have to provide the basics such as name, proof of auto insurance and drivers license. These aren’t covered in your right to be silent.

If you want to have any chance to beat a speeding ticket, you want to be civil to the officer who pulled you over. Doing stupid things like insulting the police officer or losing your temper will guarantee you get ticketed, and possibly even add to your charges. Courtesy and respect can go a long way toward getting you out of a traffic violation. And besides, the side of the highway isn’t the best place to discuss your side of it.

Don’t be afraid to try and beat a speeding ticket, because your innocence is maintained and protected, until such time you are actually found guilty in traffic court. There has to be sufficient evidence for you to be convicted, and this responsibility rests on the shoulders of the officer who wrote the citation.

The court gives equal chances to both parties, and the best way to maintain your not guilty plea is to remember the facts on what had transpired. Vague answers will definitely not help you to beat a speeding ticket filed against you.

Some people will bring a lawyer to court, I personally don’t think it is necessary as most people prefer to represent themselves and have a good chance to beat a speeding ticket by simply stating the facts clearly.

You also have a right to have a speedy trial as the court recognizes the constraints to work and personal life of attending court proceedings. Also, you can point out lack of evidence or delay trials in case the officer-in-charge does not show up in the proceeding.

The law can provide alternatives such as community service or going to traffic school in lue of payment. To beat a speeding requires you check out all options available to you before going to traffic court.

You can benefit greatly if you can beat a speeding ticket. The first thing that comes to mind is saving on your auto insurance premiums.

Traffic violations can be punishing for several reasons. Just keep in mind when trying to beat a speeding ticket, biases and abuse aren’t tolerated by the court. Which means you have as good a chance as anyone to have your speeding ticket dropped when you go to traffic court.

By knowing your legal rights, you can have a better chance to beat a speeding ticket. The traffic court gives equal opportunity to both sides to prove or disprove guilt. The Difference Amid Moving And Non Moving Parking Infractions

Thursday, October 28th, 2010

There are differences between traffic tickets. Determining the type of ticket you have is important when evaluating your situation.

Sometimes if your ticket is not a serious one that gets reported to your auto insurance company, you may be better off just paying the fine and not challenging it in court.

Traffic violations come under two main headings. They can either be moving violations or non moving violations. They usually involve smaller fines and can be something as simple as a parking or headlight ticket.

Plus, as a bonus they do not show up on your driving record, which means your auto insurance company won’t find out about them.

Common non moving violations can include failure to use your seatbelt, improper registration, no license plate or lamps, improper parking, and a broken or non working taillight.

In most cases these should just be paid. It can be a big hassle to go to traffic court for these kinds of violations. The reason is the fines for these are usually no more than $50 or so, and you could end up being in traffic court for hours. Not worth it in my judgment.

But if you felt the ticket was given unjustly, you should always attempt to resolve it in some way. For example a broken head light ticket will usually be tossed if you show proof you fixed it.

On the other hand, a moving violation is any law broken by the automobile driver while the vehicle is in motion. This type of violation is distinguished by the term ‘motion’. While a non moving violation is charged against the vehicle, a moving violations are charged against the driver of a vehicle. While usually only classifies as infractions or misdemeanors, serious violations can be felonies.

In most locations moving violations involve both a fine and points being assessed to the record of the driver. As points accumulate harsher punishments can be imposed such as being ordered to take driving classes, or even having your license suspended.

You may think we have it bad in the US, and we do, because traffic fines can go all the way up to $500 and more. But in some countries around the world, traffic can be set according to an individuals income, and in some rare cases be more than $100,000!

More common moving violations can include speeding (THE most common), failure to secure a load, failure to yield right of way, violating high occupancy vehicle lanes, or not stopping for a pedestrian.

Some of the more serious types of moving violations can include racing, driving under the influence, and vehicular homicide.

Traffic violations are also broken down into either civil or criminal. While they both have points and fines associated with them, only criminal violations can wind up you up in jail.

Sentences imposed in criminal cases are obligations owed to the state for violation of their laws. The term state can be applied to cities, towns, state or federal governments or any other kind of municipality. Obviously these are the moving violations you need to avoid at all costs.

Know Where Speed Traps Might Be To Evade These

Monday, October 25th, 2010

If there is one thing that all 50 states have in common, it’s speed traps. It’s a location where police have a reputation for writing an unusually high number of speeding tickets.

The most common areas for these hidden speed traps would be streets where the posted speed limit is not easily seen, or areas of fluctuating speed limits. It’s very easy to catch unsuspecting drivers ‘breaking the law’ in these particular areas.

Small municipalities like to set up speed traps near an interstate or major highway, where they know it is unlikely that a ticketed driver will return to fight it in court. Law enforcement realize that many drivers will use radar detectors in their attempt to evade a speeding ticket. They will render this method useless by setting up a speed trap where they will time you between two preset points with a stopwatch.

The way they do this is by knowing how long it takes to drive the distance between the two points they have chosen doing the posted speed limit. Once they have that information its a simple mathematical formula to gauge your speed. If you were speeding they will radio the speed, make, model and color of your car to an officer waiting down the road. That officer will pull you over and serve the citation.

The legality of the whole thing has been debated for years. Politicians and police officers alike have always supported controversial means to ticket drivers by preaching to us that it ‘saves lives’. We all know the real reason is to greatly increase revenue.

The bottom line is that these deceptive methods of giving out tickets is unethical and illegal. Using speed traps is literally a billion dollar industry in America.

Protect yourself from speed traps the next time you’re in your car. If you are planning a long (or even short) road trip soon, it’s advised that you know what you may be going up against.

A Georgia Speeding Violation May Be Substantially Excessive

Sunday, October 24th, 2010

Georgia speeding ticket laws are some of the most expensive in the country. Speeders caught speeding in the states of Georgia, Illinois, North Carolina, Nevada and New Hampshire all are liable to be fined up to $1000, at a judge’s discretion, for a first-time speeding offense, according to the National Highway Traffic Safety Administration.

How many points you have on your driving record, and how many miles an hour over the speed limit can also influence how much you pay in fines on a Georgia speeding ticket. Throw in speeding in a school zone, or while highway workers are present, and you can even have your license suspended, or you can be thrown in jail.

Some states including Michigan, Texas and New Jersey, operate under so-called “driver responsibility” laws, which, in some cases, can result in a further fine of up to $1000 leveled a year after the conviction. Virginia, which until 2008 had some of the strictest penalties for speeders, repealed its driver-responsibility laws last year after a public outcry.

Georgia saw fit to add up to $200 in fines onto tickets of so called “super speeders”, who exceed the limit by 10 mph or more. With this the Georgia speeding ticket can cost up to $500, before you add on court fees.

These Georgia speeding ticket add ons were passed in May this year. It also passed the so-called “superspeeders” act, which adds $200 to the fine of a driver, caught driving more than 75 mph on two-lane roads and 85 mph or more on freeways. In some counties, speeders are already leveled municipal fines that can add more than $1000 to any ticket.

According to Bob Dallas in the Office of Highway Safety, the increased fines are justified in order to deter speeders. He stated the additional speeding fines will go to Georgia’s hospital trauma centers.

He has organized public awareness about the super speeders act to make people aware. So what’s the lesson here? If you drive the speed limit, you won’t get a Georgia speeding ticket.

Nobody likes to get speeding tickets. Hopefully, this article will give readers some insight on how to fight speeding tickets.

Get your evidence together. You first want to get the traffic court to show you any documents relevant to your speeding ticket. These can include calibration records on the speedometer or radar gun used to guage your cars speed. You want to examine any documents for flaws before you go to traffic court so file a discovery request with the court in advance. The downside to filing this type of motion though is that you will remind the officer of the speeding ticket which may remind him to show up for court.

One thing that can help you fight speeding tickets is to know that devices that measure your cars speed such as radar and laser detectors can be subject to human error. Traffic tickets have been dismissed in some instances because the ticketing officer failed to document proper positioning of the speed detecting instrument.

Everybody has heard of cases of all kinds being dismissed because of a technicality. And this does happen. Certain things have to be done correctly for a speeding ticket to be valid. If for instance the officers badge number or signature is illegible you may a valid point to have your speeding ticket dismissed.

Be Brief: When fighting speeding tickets, keep in mind that judges don’t have a lot of time. Give a brief report. Additionally, use of visual evidence, such as a photo of a road sign obscured by foliage may help your case.

You can sometime fight speeding tickets and win by default. If for instance the officer doesn’t show up in traffic court, and if the court prosecutor asks for a continuance then you should object to this. The ticket should be thrown out if the officer does not have a valid reason for missing traffic court.

Obviously not getting a speeding ticket in the first place is the best way to fight it! Speeding tickets and other traffic violations can increase your car insurance for years to come.

Information On How To Terminate Speeding Violations

Sunday, October 24th, 2010

Throughout the years, there have been some pretty dreadful defense strategies used by many people when it came to their traffic ticket. But I don’t really blame them. Most were just relying on ‘insider’ information some website was selling.

This article will outline five of the biggest mistakes you can make when battling your traffic ticket in court. Familiarize yourself with them and never use them in traffic court.

Mistake #1- Delaying the traffic court date

The rationale for this, some say, is that the longer you can delay traffic court for your traffic ticket, the likelier the chance the police officer won’t show up at your court date.

Simply delaying your traffic court trial will not increase your chances of beating your traffic ticket.

My question is what if you do postpone your traffic court date and the officer still shows up?

Then what? Police officers get paid overtime to show up to traffic court.

Mistake #2- Requesting evidence before traffic court.

Don’t get me wrong, you have the legal right to view everything they plan on using to convict you. Its called discovery, and is useful before a murder trial. But this is traffic court and it can hurt your case.

Requesting evidence before any kind of trial tells the prosecution you are planning a defense. He will see this as a challenge and will undoubtedly prepare accordingly, making your chances of winning almost impossible.

Don’t request anything or even contact the courthouse at any time prior to your trial about your traffic ticket. DO NOT let them know you are familiar with the traffic court process.

Mistake #3- Doing too much needless research.

There is no need to spend any time reading boring law books. Its pointless.

Although in some cases it may be wise to look up a certain law and see how it is worded, there really is no need to do it with all traffic ticket trials.

Mistake #4- Going after the police officers credibility

Going to traffic court with the sole purpose of making the police officer look like an idiot will backfire on you and any plan you had of getting your traffic ticket thrown out. Claiming things like, “the radar gun was faulty”, or “the officer clocked the wrong vehicle”, or “the officer singled you out”, or “the officer hasn’t had adequate training with the radar/laser gun” are all useless defenses.

Never go into a courtroom with the intent to challenge the officer’s training of the radar/laser gun. This type of defense is always attacked by the judge. He will accept the officer’s testimony as to his training and will tell you to ask your next question.

Lets face it, the officer has been properly trained on the use of the speed detecting device he used to give you a traffic ticket. There is no question about it. Where would you get the evidence the judge will ask for to support this claim?

Mistake #5- Going to traffic court unprepared

This is by far the biggest mistake people will make when fighting a traffic ticket. They go to court, thinking they’ve done their homework, when in reality everything they did leading up to the trial was in vain. They’re research was done the WRONG WAY and as a result, they lose their case before they even had a chance to defend themselves.

And then there are the people who show up to traffic court thinking the judge will have pity on them if they just tell their side of the story. Yeah right!

Its understandable that it can be nerve wracking showing up to traffic court. Just remember you aren’t on trial for your life, its just a traffic ticket. Traffic court is designed to be user friendly because of the volume of people going through there daily.

If you avoid these 5 mistakes you will have a better chance of claiming your victory in traffic court, and hopefully getting that traffic ticket thrown out.
